How Do Afterborn Children Inherit

An afterborn child is a child who was conceived before the death of the parent, but who was born
after their death. According to Fla. Stat. § 732.106, afterborn children inherit from the estate of
their deceased parent as if they were born during the decedent’s lifetime.

This statute is significant because, at first glance, a child born after the death of their parent who
had no will might appear ineligible to inherit anything. This could be potentially unfair to the
child, but thankfully, the state of Florida has ensured to protect this class of children from being
accidentally disinherited.
